The documented system, not just the method
A Safe Work Method Statement is required for high risk construction work, and maintenance, cleaning and repair of a sewer, wet well or treatment plant structure is construction work — so entry into these assets needs one. But a SWMS only documents the method. It references the entry permit, the rescue plan and the gas detection regime; it is not any of them. Separately and independently, the confined space duties in Part 4.3 of the WHS Regulation 2025 (NSW) apply to every confined space entry, whether or not it is construction work: an entry permit, atmospheric monitoring, a standby person and rescue arrangements established before entry. An organisation holding only SWMS has documented its method and left its permit system, its rescue arrangements and its instrument discipline undocumented.

Where holding only a SWMS goes wrong
A NSW council operates a sewer network, a dozen sewage pump stations and two treatment plants. It already holds a confined space SWMS, so it believes it is covered. A crew is sent to a maintenance hole in a township main street after a blockage report. They have a SWMS. They do not have a permit system, so nobody formally verifies that the upstream pump station is locked out. They have a four-gas detector, but it has not been bump tested for six weeks and its H2S sensor is near end of life, so it reads low. They set up cones rather than a traffic guidance scheme, because the SWMS describes the entry, not the road. One worker descends on a ladder without a retrieval line, because the tripod is on another truck. Every one of those failures sits outside the SWMS and inside the four documents this pack adds. The entry permit would have forced the isolation check and refused entry on an out-of-date instrument. The calibration procedure would have caught the sensor. The rescue plan would have stopped the descent without a retrieval line rigged. The maintenance hole SWMS would have required the traffic scheme before the lid came off. The council was not short a SWMS. It was short a system, and the gap is where people die.

Construction work carried out in or near a confined space
Every asset covered by this pack — sewer, maintenance hole, wet well, pump station chamber, treatment plant tank, channel and digester — is an enclosed structure not intended for human occupancy, entered for maintenance with restricted entry and egress and a hazardous atmosphere.
Work carried out in or near a contaminated or flammable atmosphere
Wastewater atmospheres routinely contain hydrogen sulphide, may be oxygen-deficient, and can contain flammable methane; digester and biogas structures carry both at far higher concentration.
Construction work carried out on, in or adjacent to a road, railway, shipping lane or other traffic corridor in use by traffic other than pedestrians
Maintenance holes in a road reserve are opened and entered from within or beside a live carriageway — this applies to the maintenance hole SWMS in the pack and is the category most often missed in generic template sets.
Construction work carried out in or near water or other liquid that involves a risk of drowning
Sewers, wet wells and chambers carry live flow and can surge or fill from an upstream discharge or pump start while a worker is inside.
Construction work involving a risk of a person falling more than 2 metres
Descent into chambers, wet wells and tanks, and work around open plant structures, commonly involves a fall risk exceeding 2 m.
The entry tasks covered by this pack are high risk construction work under Section 291 of the WHS Regulation 2025 (NSW), so a SWMS must be prepared before work commences (Section 299), kept readily accessible, reviewed as necessary (Section 302), and given to the principal contractor if one is appointed. Critically, the confined space provisions in Part 4.3 apply in full and independently of construction status — an entry permit, atmospheric monitoring, a standby person and rescue arrangements established before entry are required for any confined space entry, including routine operational entry that is not construction work. Hydrogen sulphide is a hazardous chemical and a PCBU must ensure no person is exposed above the workplace exposure standard, which in a wet well or chamber generally requires monitoring data rather than assumption. An H2S exposure, an asphyxiation, a biogas fire or explosion, a confined space incident or a traffic strike causing death or serious injury is prosecuted as a Category 1 or Category 2 offence under the WHS Act 2011 (NSW), with the most serious breaches carrying imprisonment for individuals, and the duty of care extends to members of the public near an open chamber in a road reserve.
